Terms & Conditions

In these terms and conditions the term “RSS’ refers to ‘Riviera Sea School’, its ‘instructors’ or any ‘sub-contracted person’.

Bookings and cancellations

A separate booking form must be filled out for each participant. Your place on the course is secure when you have completed a booking form and a 25% deposit has been received. In the event of your wishing to cancel your place on the course the following fees will apply:

- Greater than four weeks until your course:  A full refund will be made minus 80 euros administration charge.

- Less than four weeks until your course: Your 25% deposit will be retained.

- Less than two weeks until your course: The full fee of your course will be paid unless we are able to ‘resell’ your place in which liability will be limited to an 80 administration charge. Whether or not we are able to resell your place may not be confirmed until the first of the scheduled course.

- In the event that you wish to change the date of your course we will do our utmost to accommodate the change at no further cost. This is dependant on the notice given and our ability the ‘resell’ your place – as per the terms above. In the event that you are unable to attend your course then you are liable for the full cost of the course.

Payment

All participants must pay a minimum 25% deposit in order to secure a place on any given course. The remainder of the course fee is payable two weeks before the start of your course.  Participants will not be allowed to begin the course unless the full payment has been made.

Cancellation by RSS

In the event of a cancellation by RSS the school will offer an alternative date or a full refund will be made. Riviera Sea School will not however be liable to any expenditure or loss of earnings that has been incurred by the client. If a cancellation (for any reason or circumstance) is made, RSS will only be liable to refund the course fees paid.

Age Restrictions

No participants under the age of 12 will be permitted to participate in any given course, identification may be asked for proof of age. Participants between the ages of 12-16 must have the parental consent section of the booking form completed and signed by a parent or legal guardian. There is no maximum age for participation but it is the participants’ responsibility to make the decision as to whether they are fit and healthy enough to perform all the tasks required to complete the course. No participants under the age of 16 will be permitted to participate in any PWC courses due to current local regulations.

Insurance

RSS will not accept responsibility for any loss, damage or injury suffered by persons and/or their property arising out of or during the course of the activities whilst training unless such injury, loss or damage was caused or resulted from negligence or deliberate act. The participant acknowledges that there are inherent dangers involved in power boating and understands and agrees to sign the booking form indemnity holding RSS and its instructors free of liability in the event of an accident, death, injury or damage to person or property. Students are strongly recommended to take out personal insurance against the above.

Own boat tuition

Vessels used for own boat tuition are the sole responsibility of the Boat Owner/Captain. Adequate insurance will be in place to cover all eventualities. RSS will not accept responsibility for any loss, damage or injury suffered by persons and/or their property during own boat tuition.

Alcohol and Drugs

If the instructor suspects that the participant is under the influence of Alcohol or any drug that may impair his/her ability to perform any given task the instructor has the right to terminate that participant’s involvement in the course and will be dismissed. In this instance no refund will be made and the course will not be rescheduled. The final decision of this matter rests with the instructor. 

Certification

Certificates will not be issued automatically; each participant must satisfy and meet the criteria of the course on which they are participating. If the participant does not meet these requirements then RSS will create an Action Plan to help you achieve your award

Force Majeure

RSS will not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or any other natural disaster), military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, labor dispute, strike, lockout or interruption or failure of electricity (or telephone service) or breakdown or accident to any technical equipment required to run any given course. In any such circumstance RSS will endeavor to continue the course or fulfill the booking but will have no liability to the participant to do so. The participant will be liable to pay for any training that has been conducted to that point. In the case of course incompletion RSS will refund the participant any excess that has been paid. It is at the discretion of RSS as to the cost of any partially conducted courses.

Complaints

If for any reason the participant is unsatisfied with the training they are receiving the participant will be expected to raise their concern(s) or complaint(s) at the earliest opportunity. RSS will not attempt to resolve any issues that could have been resolved during the course if raised after the course has been completed.

Others

You consent to any photos being taken of you during training and feedback given to RSS to be used in publicity material. You consent to receiving emails and letters from us relating to our business activity. Your details will never be passed onto another company.
